Product Replacement and Return Policy

The regulation of product replacement and return is governed by the following rules:

1. The consumer has the right to replace or return goods and reclaim their paid value within a period of fourteen days from the date of purchase, unless the warranty condition announced by the merchant or custom dictates a longer period.

2. Goods must be returned in cases where a defect or fault is discovered, even if it is repairable, or if they do not conform to the approved standard specifications within the State of Kuwait.

3. If a product cannot be replaced, it must be returned, and the seller must refund its price according to the value stated in the sales invoices, using the same method used at the time of purchase or any other method accepted by the consumer.

4. The consumer's right to exercise the right of return or replacement shall not be forfeited when the conditions stated in this regulation are met, even if the goods were purchased during commercial offers (sales) licensed by the Ministry of Commerce and Industry. In this case, the refund of the price shall be based on the value of the goods stated in the sales invoices and by the same method used at the time of purchase.

5. If it is found that the product subject to return or replacement is fraudulent, counterfeit, or does not conform to the mandatory standard specifications approved in the State of Kuwait, the consumer has the right to reclaim its value from the seller in cash, without prejudice to their right to take the prescribed legal actions in this regard, as applicable, against the offending seller.

6. If the reason for replacement is related to sizes, the buyer must exercise the right of replacement or return within a period not exceeding five days. In the absence of an alternative size, the consumer has the option to return and reclaim the value of the product, provided that the size option is proven in the purchase invoice.

7. If it is found that the product does not conform to what was agreed upon, the consumer has the right to return it and reclaim its value.

The consumer may not exercise the right of return or replacement in the following cases:

1. If the consumer was aware of the defect or fault in the product at the time of purchase and accepted it in its condition, and this was documented in the purchase invoice.

2. If the nature, characteristics, or method of packaging or wrapping of the product prevents its replacement or return, such as its damage or the impossibility of returning it to the state it was in at the time of purchase in a way that prevents its resale, unless the reason for return and replacement is due to manufacturing defects, violations of mandatory standard specifications, or if the goods do not conform to what was agreed upon as a result of fraud in specifications and components.

3. Perishable consumer goods are excluded, unless their spoilage or expiry for human consumption is proven at the date of purchase, or goods manufactured according to specifications determined by the consumer, and books, newspapers, and magazines.
